A lot of the time its down to the interpritation of the MOT Rules & Regs that is applied to individual cars by the MOT Tester himself (or "herself" not wanting to be sexist here!!!) ;D

That point about the car having rear fog lights or not for a certain age for example.
If they aint there, they cant be "tested" although not having them may be wrong, should that be an MOT Failure

was only asking as some are more lenient and also if a tester isnt used to the set up of the mini might fail or advise something that shouldnt be. as i found when i was a mechanic. we failed some bushes because we knew more about a certain model of vehicle and their problems which had been picked up by the garage who serviced it but didnt think they were that bad. so didnt say anything

My regular tester is brilliant. He passed my transporter when the dashboard wasn't wired in, and emmision tested my supercharged civic as a non-cat car because the cat had been removed! I wouldn't like to say who or where he is though!
The only time a tester would fail a car is if there's something glaringly obvious which a VOSA inspector would pick up on straight away. They have the power to enter and inspect an MOT garage without notification. Thats what the testers are more worried about.
Unless of course your car is held together with blu-tack and a prayer!
